The Death Knell of Eskom: A Monopoly’s Demise

The 20-year cap on generation, transmission, and system operation licences may limit the ability of new entrants to recover their investments, while the minister’s wide-ranging powers may create uncertainty for investors. The lack of clarity on third-party access to transmission and distribution infrastructure may also slow down the evolution of market competition.

The success of the new law will depend on the implementation of its provisions. The draft market code and description of the market model are crucial documents that will shape the future of the industry. The government must ensure that these documents are finalized quickly and that the new market is designed to promote competition and efficiency.
