The company’s draconian non-disclosure agreements (NDAs) are designed to silence whistleblowers and protect its own interests, rather than promoting transparency and accountability.
The letter, sent to Securities and Exchange Commission Chair Gary Gensler, accuses OpenAI of engaging in a pattern of illegal behavior, including forcing employees to waive their rights to whistleblower incentives and compensation. The company’s NDAs are so restrictive that they even require employees to notify OpenAI before communicating with government regulators, effectively gagging them from speaking out about potential wrongdoing.
But that’s not all. The letter also alleges that OpenAI’s NDAs violate the law by requiring employees to sign illegally restrictive contracts to obtain employment, severance payments, and other financial consideration. Senator Chuck Grassley (R-Iowa) has also weighed in on the issue, calling OpenAI’s policies and practices "chilling" and stating that they "cast a chilling effect on whistleblowers’ right to speak up and receive due compensation for their protected disclosures." He’s right. OpenAI’s actions are a clear attempt to silence whistleblowers and prevent them from speaking out about potential wrongdoing.
It’s time for OpenAI to come clean about its policies and practices. The company’s NDAs must be reformed to protect whistleblowers’ rights and promote transparency and accountability. Anything less is unacceptable.
UPDATE: OpenAI’s CEO Sam Altman has been accused of using his company’s NDAs to silence whistleblowers and protect his own interests. His apology for the company’s earlier exit agreement controversy rings hollow in light of these new allegations.
